TERMS OF SERVICE.

1. Services
DEW GARDENS LLC provides residential and small commercial edible landscape design, raised bed installation, and garden maintenance services in the greater San Diego, CA metropolitan area. These Terms govern use of our website and engagement of our services.
2. Site Assessments
Our paid site assessment ($95) is a professional services engagement that includes a 60-minute property visit and written assessment summary. The assessment fee is credited toward any DEW GARDENS design or installation project initiated within four months of the assessment.
3. Design and Installation
Design projects are governed by a separate written Project Agreement specifying scope, fees, and timeline. Installation projects require a 50% deposit before work begins. The balance is due upon project completion. We source plant material from regional California nurseries when available.
4. Seasonal Care Plans
Seasonal care plan agreements require a minimum six-month commitment billed monthly. Thirty days written notice required for cancellation. Care plans are available only in the San Diego area service area.
5. Plant Establishment Guarantee
All plants installed by DEW GARDENS carry a 90-day establishment guarantee against nursery defect or incorrect installation. This guarantee requires the client to follow DEW GARDENS's written care instructions, including irrigation specifications, during the establishment period. Plants that fail due to client error, pest damage, extreme weather, or conditions not present at assessment are not covered.
6. Payment
Invoices are due within 15 days. Accounts 30 days past due incur 1.5% monthly interest. We accept check, ACH, and credit card (3% processing fee for card payments).
7. Intellectual Property
All garden designs, planting plans, and written materials created by DEW GARDENS are our intellectual property. Clients receive a license to use design documents for their specific property only.
8. Limitation of Liability
DEW GARDENS's liability for any service engagement shall not exceed the total fees paid for that specific engagement. We are not liable for indirect or consequential damages. Edible garden success depends on variables including weather, pest activity, and client follow-through that are beyond our control.
9. Governing Law
These terms are governed by the laws of the State of California. Disputes shall be resolved in Davidson County, California.
